Let Ink Be, established at Dorlandweg 3 in Roosendaal, the Netherlands.
1. Definitions
Client: the natural person who commissions Let Ink Be to apply a tattoo, receives treatment from Let Ink Be or purchases products or services.
Agreement: any agreement between Let Ink Be and the client concerning products or services, including applying a tattoo.
2. Applicability
These terms apply to all agreements in which Let Ink Be acts as seller or supplier of products or services. Deviations apply only when Let Ink Be has expressly agreed to them in writing beforehand. Let Ink Be remains the supplier when employees or third parties are used in performance. Entering into an agreement constitutes acceptance of these terms.
3. Personal responsibility and risk
Instructions are given under the client's responsibility and at the client's risk. By commissioning work, the client acknowledges possible medical, psychological and social consequences and understands that a tattoo cannot always be removed completely or with a cosmetically attractive result.
The client must disclose relevant health information honestly and must not present a risk to employees or third parties. Let Ink Be does not treat anyone under 16. Clients aged 16 or 17 require written consent and the presence of a parent or guardian, who then acts as the client.
Let Ink Be may request valid identification and refuse treatment if it is not provided. In that event, the deposit may be offset and a new appointment may be required.
4. Liability
Let Ink Be has an obligation to use its best efforts but cannot guarantee the intended result. Liability for a result not being achieved in full or for treatment-related damage is excluded, except in cases of proven intent or gross negligence.
If Let Ink Be is nevertheless liable, compensation is limited to the amount charged for the relevant service. A client must mitigate damage and provide relevant information immediately. Statutory and contractual defences also apply to employees and engaged third parties.
5. Pigments
Let Ink Be uses only tattoo pigments that comply with applicable legal requirements and are subject to supervision by the competent authorities.
6. Governing law and competent court
Dutch law applies to these terms and related agreements. Disputes are handled by the competent court in Breda, unless Let Ink Be, as claimant or applicant, expressly chooses the competent court in the client's place of residence or establishment.
7. Conversion
If a provision cannot be applied because of reasonableness, fairness or an unreasonably onerous nature, it will be interpreted as far as possible in a corresponding and enforceable manner.
8. Final provision
These terms also benefit employees of Let Ink Be and third parties engaged in performance. This does not mean that they perform the agreement in a personal capacity.
